These Terms of Service (“Terms”) form a binding agreement between you (“you,” “your,” “Client,” “Signer,” or “Customer”) and Greater Sacramento Notary & Apostille (“Company,” “we,” “us,” “our”).

By accessing the Site, requesting a quote, booking an appointment, submitting information through forms, communicating with us by phone/SMS/email, paying any fee or deposit, or using any of our services, you agree to these Terms.

If you do not agree, do not use the Site or services.


1) SCOPE OF TERMS

These Terms apply to all services and interactions, including without limitation:

  1. Mobile Notary Services (traveling notary services)

  2. Apostille Services / Apostille Assistance (document handling, coordination, submission support)

  3. Loan Signing Agent / Notary Signing Agent Services (loan package signings and notarizations)

  4. Business/Office Notary Services (on-site notary solutions for businesses)

  5. Hospital / Senior Facility / Jail / Correctional Facility / Medical Notary Visits (where allowed and safe)

  6. Printing, scanning, copying, document pickup/drop-off, courier coordination, shipping coordination (when offered)

  7. Any related communications, scheduling, payments, travel, and recordkeeping

If you are booking on behalf of another person (the signer), you represent you have authority to do so and you agree to these Terms on their behalf, to the fullest extent permitted by law.


2) IMPORTANT DISCLOSURES (READ CAREFULLY)
2.1 Not a Law Firm; No Legal Advice

We are not attorneys and do not provide legal advice. We do not:

  • Draft legal documents (unless you supply the document; we do not create it)

  • Advise which document you should use

  • Interpret the meaning or legal effect of documents

  • Advise whether you should sign

  • Provide immigration advice, financial advice, or representation

We may provide general, non-legal information about common process steps (e.g., where signatures go, typical document requirements, general apostille flow). For legal guidance, consult a California-licensed attorney.

2.2 Not a Government Agency; No Control Over Agency Decisions

We are not the California Secretary of State, County Recorder, court, vital records office, consulate, embassy, or any foreign government office. Those entities control acceptance decisions and processing times. We do not guarantee acceptance, processing speed, issuance, or outcomes.

2.3 No Guarantee of Third-Party Acceptance

Banks, title/escrow companies, lenders, courts, employers, schools, consulates, and foreign authorities can reject documents for reasons outside our control. We do not guarantee acceptance or results by any third party.

2.4 Compliance and Safety

We comply with applicable California notary laws, regulations, and ethical obligations. We may refuse service when required by law or when necessary for safety.


3) DEFINITIONS (FOR CLARITY)
  • “Notarial Act” means a notarization performed under California law (e.g., acknowledgment, jurat, oath/affirmation, etc.).

  • “Apostille Assistance” means document intake, review for completeness (non-legal), coordination, handling, and submission support—not the government’s act of issuing an apostille.

  • “Loan Signing” means facilitating execution of loan documents and returning them per provided instructions, including notarizations where required.

  • “Travel Fee” means a fee for dispatching a notary to a location, separate from statutory notary fees.


4) ELIGIBILITY AND CLIENT REPRESENTATIONS

You represent and warrant that:

  1. You are at least 18 years old, or you are a legally authorized representative for the signer.

  2. You have authority to request services and to agree to these Terms.

  3. All information you provide (names, addresses, document types, IDs, requirements) is accurate.

  4. You will not use our services for unlawful purposes, fraud, coercion, identity misuse, or document falsification.


5) SERVICES OFFERED
5.1 Mobile Notary Services

We provide mobile notary services within our Service Area, traveling to homes, offices, hospitals, senior facilities, jails/correctional facilities (where allowed), and other agreed locations.

Common document categories we notarize include (non-exhaustive):

  • Powers of Attorney (financial/medical)

  • Affidavits, sworn statements, declarations

  • Healthcare directives, medical forms (where permitted)

  • Trusts and estate planning documents (client-provided)

  • Real estate documents (deeds, acknowledgments/jurats within closing docs)

  • Business agreements and authorizations

  • Minor travel consent forms

  • DMV/vehicle related forms (when notarization is required/allowed)

  • Other lawful documents requiring a California notary

We do not verify the truth of document content. Notarization verifies identity, willingness, and/or oath/affirmation, and completes a notarial certificate—not the underlying facts.

5.2 Apostille Services / Apostille Assistance (California)

We provide apostille support for eligible documents intended for use abroad. Services may include:

  • Reviewing documents for common rejection issues (non-legal)

  • Coordinating notarization if required

  • Coordinating certified copies/vital record routing instructions (non-legal, informational)

  • Submitting documents to appropriate government offices (as permitted)

  • Pickup/return coordination and shipping coordination

We do not issue apostilles. Apostilles are issued by government authorities.

5.3 Loan Signing Agent / Notary Signing Agent Services

We provide loan signing services for common packages (including but not limited to):

  • Refinance (rate/term and cash-out)

  • Purchase (buyer package)

  • Seller package

  • HELOC / Home equity loan

  • Loan modifications

  • Reverse mortgage

  • Deed of Trust / Grant Deed documents included in loan files

  • Out-of-state / remote loan packages requiring a local signing appointment

Our role includes:

  • Verifying identity

  • Notarizing where required and lawful

  • Ensuring signatures/initials are executed as instructed (without legal advice)

  • Returning packages per instructions

We do not explain interest rates, loan terms, or legal consequences. Borrowers must contact their lender/title/escrow for those questions.

5.4 Business Services and On-Call Notary Support

We may offer notary support to businesses (offices, hospitals, senior facilities, law firms, property managers, etc.), including recurring service arrangements or retainers (if offered separately). Any business arrangement may be governed by separate written terms.


6) APPOINTMENTS, SCHEDULING, AND SERVICE AREA RULES
6.1 Confirmation Required

Appointments are not guaranteed until we confirm (by SMS/email/phone) the date, time window, location, and fee estimate (when available).

6.2 Accurate Location and Access Required

You must provide accurate:

  • Address, unit number, parking instructions, gate codes

  • Facility entry procedures (hospital, jail, senior facility)

  • Contact person name and phone for access issues

If we arrive and cannot access the location due to missing/incorrect instructions, delays, or denial of entry, it may be treated as a No-Show (see Section 9).

6.3 Time Windows and Delays

We may provide ETA windows. Traffic, prior appointments, facility access, and unforeseen delays may impact arrival time. We will communicate reasonable updates when possible.

6.4 After-Hours / Same-Day / Holiday Scheduling

Same-day, rush, after-hours, weekend, and holiday availability may be offered with additional fees and is not guaranteed.


7) SIGNER REQUIREMENTS: IDENTIFICATION, WILLINGNESS, CAPACITY
7.1 ID Requirements (California)

All signers must present valid, unexpired, acceptable government-issued photo identification as required under California notary law, or otherwise meet lawful identification requirements. If ID is not acceptable, we will refuse notarization.

7.2 Signer Must Be Present and Able

The signer must be physically present at the time of notarization (unless a legally compliant remote process is explicitly offered—which is not assumed).

7.3 Willingness and Awareness

We will not proceed if we reasonably believe the signer:

  • Is not acting willingly

  • Is under duress/coercion

  • Does not understand what they are signing

  • Is unable to communicate sufficiently for the notarial act

  • Appears incapacitated or impaired such that lawful notarization cannot be performed

7.4 Refusal Is Final When Required by Law

You acknowledge the notary has a legal duty to refuse service under certain circumstances. Refusal may still trigger travel/time charges (see Section 9).


8) DOCUMENT READINESS AND CLIENT RESPONSIBILITIES

You agree that you are responsible for:

  1. Providing the correct documents and correct signer(s)

  2. Ensuring documents are complete except for signatures that must be executed in the notary’s presence

  3. Confirming the destination requirements for apostille/foreign use when known

  4. Ensuring all parties who must sign are present and available

  5. Ensuring witnesses are present if your document requires witnesses (we do not guarantee we can supply witnesses)

  6. Ensuring the signer has acceptable ID and is prepared to sign

We may refuse to notarize documents with missing pages, blank spaces that should be completed, or unlawful requests, as required by law and best practice.


9) FEES, DEPOSITS, PAYMENTS, CANCELLATIONS, AND NO-SHOWS
9.1 Fee Components

Total charges may include:

  • Statutory California notary fees (per notarial act/signature, as permitted by law)

  • Travel fee (distance, time, location complexity, parking, access)

  • After-hours / rush / holiday fee / emergency fee

  • Waiting time fee

  • Printing/scanning/copying fees (if offered)

  • Apostille handling/service fees (Company service fee)

  • Government fees (where applicable)

  • Shipping/courier costs (labels, postage, carrier fees)

  • Loan signing package fees (printing, travel, drop-off, scanbacks, etc., if included)

9.2 Quotes Are Estimates

Quotes are based on information provided. If the job scope changes (more signers, more notarizations, additional travel, additional documents, re-trip), the price may change.

9.3 Security Deposit to Reserve Time

We may require a security deposit to reserve an appointment time. Unless required otherwise by law or explicitly stated in writing:

  • Deposits are applied to the final invoice.

  • Deposits may be non-refundable in cases of late cancellation or No-Show, as described below.

9.4 Cancellation 

Overview

This Cancellation / No-Show Policy explains how appointment reservations, deposits, travel, waiting time, and late cancellations are handled for Mobile Notary, Apostille Services, and Loan Signing Agent appointments across Greater Sacramento.

By booking an appointment, you agree to this policy.

9.4.1 Appointment Reservation Deposit (Required)

To reserve an appointment time, we require a minimum $79 deposit (“Reservation Deposit”).

  • The Reservation Deposit is credited toward your final invoice after services are completed.

  • The Reservation Deposit helps cover scheduling, travel planning, and reserved time.

  • Additional deposits may be required for after-hours, long-distance travel, multi-signer appointments, large document sets, or expedited apostille handling.

9.4.2 Cancellations

Standard Cancellations

If you need to cancel, notify us as soon as possible by text or phone using the number on our website.

Late Cancellations

A cancellation may be considered late if it occurs:

  • within 2 hours of the scheduled appointment time, or

  • after the notary has already been dispatched / is en route.

Late cancellations may result in the Reservation Deposit being retained as a cancellation fee and/or additional travel charges depending on distance and time already incurred.

9.5 No-Show Policy (What Counts as a No-Show)

A No-Show includes, without limitation:

  1. The signer is not present at the confirmed location/time.

  2. The address provided is incorrect/incomplete and we arrive at the wrong location.

  3. The signer refuses to sign after we arrive.

  4. The signer cannot provide acceptable, valid ID.

  5. The document is not ready (missing pages / not available at the appointment).

  6. The location cannot be accessed due to missing gate codes, entry approvals, room info, or facility restrictions.

  7. The signer is not willing/able to proceed (capacity/duress concerns) and we must refuse service to comply with law.

In No-Show situations, the Reservation Deposit is non-refundable and may be applied to travel/time already incurred.

9.6 Waiting Time Charges

We plan our schedule around your appointment time. If the signer is not ready at the agreed time, waiting time fees apply.

  • Waiting time is charged at $20 per 15 minutes (minimum charge).

  • Waiting time begins after a 10-minute grace period, unless the delay is caused by us.

  • Waiting time is billed in 15-minute increments.

9.7 Rescheduling

If you need to reschedule, please contact us as soon as possible. Rescheduling requests are subject to availability and will only be catered atleast 2 hours before the appointment time.

  • If rescheduling occurs after dispatch or within the late-cancellation window, we may apply the Reservation Deposit to the rescheduled appointment one time at our discretion.

  • Second or later reschedules may require a new deposit.

9.8 On-Site Refusal / Inability to Complete Service

If we arrive and cannot complete service due to issues outside our control (ID problems, missing signer, missing documents, refusal to sign, unsafe environment, facility access denied), you agree that:

  • the Reservation Deposit will be retained, and

  • additional travel/time fees may apply.

Unless we specify different terms in writing:

  • Cancellations with sufficient notice may avoid additional charges.

  • Late cancellations may result in charges for reserved time, travel, and administrative costs.

Recommended booking rule (you can adjust):

  • Cancellation within 12 hours of appointment time may be considered late.

9.10 Payment Methods and Due Time

We may accept cash, card, or electronic payment methods. Payment is due at the time of service unless otherwise agreed in writing (e.g., approved invoicing for business clients).

9.11 Chargebacks and Payment Disputes

If you dispute charges without contacting us first, you agree we may provide service records (appointment confirmations, travel logs, time stamps, and notary journal details as allowed) to the payment processor. You remain responsible for lawful fees due for reserved time, travel, and services rendered.

9.12 Returned Payments / Collections

Returned payments may incur administrative fees and collection costs where permitted by law.


10) APOSTILLE-SPECIFIC TERMS (CALIFORNIA)
10.1 No Guarantee of Acceptance or Timing

Apostille processing outcomes depend on government review and requirements. We do not guarantee:

  • acceptance,

  • issuance,

  • turnaround time,

  • or that a document will be accepted in the destination country.

10.2 Common Reasons for Rejection

Documents can be rejected for reasons such as improper notarization, missing certificates, incorrect certified copies, mismatch of names, outdated or unacceptable versions, or destination-specific requirements.

10.3 Client Cooperation

You agree to promptly provide requested information and respond to questions about document origin, destination country, and urgency.

10.4 Third-Party Fees and Non-Refundable Costs

Government fees, shipping fees, and third-party costs are often non-refundable once incurred. Our service fees may also be non-refundable once work begins (document review, submission preparation, courier dispatch), to the extent disclosed at checkout/booking and permitted by law.

10.5 Shipping and Handling Risk

If shipping is used, delays or losses may occur. We are not responsible for carrier delays, misdelivery, theft, or loss beyond our control. You may request upgraded shipping at your expense.


11) LOAN SIGNING AGENT TERMS (TITLE/ESCROW/LENDER/SIGNING SERVICE + BORROWERS)
11.1 Role and Limits

We facilitate execution and notarization. We do not:

  • explain loan terms, APR, or contractual meaning

  • advise whether to sign

  • negotiate on behalf of any party

11.2 Document Delivery and Instructions

For business clients: You are responsible for providing complete documents and clear instructions. If documents are late, incomplete, or require redraw/reprint, fees may apply and the appointment may need rescheduling.

11.3 Scanbacks / Drop-offs / Shipping

If scanbacks, courier drop-off, or shipping is requested, you must provide instructions and labels where applicable. Additional fees may apply.

11.4 Errors and Re-Signs

If a re-sign is needed due to our notarial error, we will make commercially reasonable efforts to correct it (where lawful and feasible). If a re-sign is needed due to borrower refusal, ID issues, redraws, or client changes, additional fees may apply.


12) REFUSAL OF SERVICE AND TERMINATION OF APPOINTMENT

We may refuse or terminate a service appointment when:

  • Identification is insufficient or suspicious

  • The signer lacks willingness or capacity

  • coercion/duress is suspected

  • The request appears illegal or fraudulent

  • The environment is unsafe

  • harassment/threats occur

  • Documents are incomplete in a way that prevents lawful notarization

  • facility policies block access or compliance

You will still be responsible for travel/time charges and/or non-refundable reservation deposits as permitted by law and disclosed at booking.


13) SAFETY, CONDUCT, AND ENVIRONMENT

You agree to provide a safe environment. We may leave immediately if we feel unsafe. Threatening behavior, harassment, discrimination, or illegal activity will not be tolerated and may be reported to authorities. Fees for travel/reserved time may still apply.


14) COMMUNICATIONS CONSENT (CALLS/TEXTS/EMAIL)

By providing your contact information, you consent to receive transactional communications related to:

  • quotes, scheduling, confirmations

  • reminders, updates, arrival notices

  • apostille or signing status updates

  • receipts/invoices

These are non-marketing communications unless you separately opt into marketing. Message and data rates may apply to SMS/text messages depending on your carrier and plan. Carriers are not liable for delayed or undelivered messages. You may opt out of text messages at any time by replying STOP. For help, reply HELP or contact us directly. Opting out of service-related texts may limit our ability to coordinate service or provide appointment updates.


15) WEBSITE USE; INTELLECTUAL PROPERTY

All Site content (text, branding, logos, design) is owned by or licensed to us and is protected by intellectual property laws. You may not copy, reproduce, republish, scrape, or commercially exploit Site content without written permission.


16) PRIVACY

Our collection and use of personal information is described in our Privacy Policy (posted on the Site). By using our services, you acknowledge you reviewed the Privacy Policy.


17) DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except where prohibited.

We do not warrant that:

  • any document will be accepted by a third party

  • any apostille will be issued

  • any loan will fund or record by a specific date

  • any particular outcome will occur


18) LIMITATION OF LIABILITY 

To the fullest extent permitted by California law:

  1. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of opportunity, delays in funding/recording, missed deadlines caused by third parties, or rejection by agencies/companies.

  2. Our total cumulative liability for any claim arising from or related to services is limited to the amount you actually paid us for the specific service/appointment giving rise to the claim.

  3. We are not liable for delays or losses caused by government agencies, carriers, facility access issues, incorrect instructions, incomplete documents, signer refusal, lack of capacity, or ID issues.

  4. If correction of a notarial certificate is required due to our error, your exclusive remedy is correction/re-performance where lawful and feasible, subject to the liability cap.

Some limitations may not apply in all cases; nothing here limits liability where prohibited by law.


19) INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company and its owners, contractors, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of:

  • the content, legality, or use of your documents

  • incorrect information/instructions you provided

  • signer incapacity, coercion, or lack of authority

  • third-party rejection or misuse of notarized/apostilled documents

  • your breach of these Terms


20) ACKNOWLEDGEMENTS AND CONSENTS

By using our services, you acknowledge and agree:

  1. We do not provide legal advice or representation.

  2. Notarization is not verification of document truth, legality, or enforceability.

  3. Apostille issuance and acceptance depend on government authorities and destination requirements; outcomes/timing are not guaranteed.

  4. We may refuse service to comply with law, ethics, or safety.

  5. You are responsible for document completeness and correctness and for ensuring the signer is present, willing, and properly identified.

  6. Disputes must be brought individually (no class/representative actions) to the extent permitted by law.


21) DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER 
21.1 Informal Resolution First (Required)

Before either party files a claim in arbitration or court, you agree to contact us and attempt in good faith to resolve the dispute informally. You must send written notice to:

Your notice must include: your name, contact info, a description of the issue, relevant dates, and the relief requested. We will respond within 30 days.

This informal process is a condition precedent to arbitration, except for eligible Small Claims actions.

21.2 Agreement to Arbitrate (Binding; Individual Basis)

You and we agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, communications, pricing, deposits, cancellations/no-shows, travel, notarizations, apostille assistance, loan signing services, or the relationship between you and us (“Disputes”) will be resolved by final and binding arbitration on an individual basis, except as stated in the Small Claims section.

This applies to claims based in contract, tort, statute, misrepresentation, fraud, or any other legal theory, to the fullest extent permitted by law.

21.3 Governing Law (FAA + California)

This arbitration agreement is governed by the Federal Arbitration Act (FAA) to the fullest extent permitted. Where state law applies, California law applies.

21.4 Administrator and Rules (AAA)

Arbitration will be administered by the American Arbitration Association (AAA) using:

  • AAA Consumer Arbitration Rules for consumer disputes, and/or

  • AAA Commercial Arbitration Rules for business disputes

If AAA is unavailable, the parties will select a comparable provider. If they cannot agree, a court may appoint one.

21.5 Small Claims Court Carve-Out

Either party may bring an individual claim in Small Claims Court if the claim qualifies and remains there. If it is transferred, removed, consolidated, or appealed such that it no longer remains in Small Claims Court, it must proceed in arbitration.

21.6 No Class Actions; No Representative Actions; No Consolidation

All Disputes must be brought only on an individual basis. You and we waive:

  • class actions, class arbitrations, mass actions

  • consolidated or combined proceedings

  • representative actions, including private attorney general actions to the extent permitted by law

If a court finds the waiver unenforceable for a particular claim, that claim will be severed and proceed in court, while all other claims proceed in arbitration.

21.7 Location; Arbitrator; “Desk Arbitration”
  • Arbitration will be before one neutral arbitrator.

  • Unless the parties agree otherwise, it will take place in Sacramento County, California, or another county where services were provided.

  • For disputes seeking $15,000 or less, the arbitration may be conducted as a document-only (“desk”) arbitration, with no hearing unless required by the arbitrator or approved upon request.

21.8 Fees and Costs

Fees will be allocated per AAA rules and applicable law. Where required by AAA consumer rules, we will pay the administrator’s fees beyond what you would pay to file a similar case in court.

21.9 Arbitrator Authority; Relief Limits

The arbitrator may award only relief available in court on an individual basis under applicable law. No relief may be awarded for non-parties.

21.10 Court Authority Over Enforceability

A court decides issues about the formation, enforceability, and validity of this arbitration provision (including the class waiver), except where law requires otherwise.

21.11 Jury Trial Waiver

To the fullest extent permitted by law, you and we waive the right to a trial by jury for any Dispute that is not arbitrated.

21.12 Survival

This arbitration agreement survives termination of these Terms and completion of services.

Optional (fairness/enforceability booster): If you want an arbitration opt-out clause, tell me and I’ll add one cleanly.


22) SEVERABILITY (INCLUDING ARBITRATION)

If any provision of these Terms is held invalid or unenforceable, the remainder will remain in full force. A court may modify or sever any invalid portion to the minimum extent necessary to make it enforceable consistent with the parties’ intent.


23) GOVERNING LAW; VENUE (FOR NON-ARBITRABLE MATTERS)

For any matter not subject to arbitration (e.g., Small Claims or a severed claim), California law governs, and venue will be in courts located in Sacramento County, California, unless otherwise required by law.


24) CHANGES TO THESE TERMS

We may update these Terms at any time. The “Last Updated” date will reflect changes. Continued use of the Site or services after changes constitutes acceptance.


25) ENTIRE AGREEMENT

These Terms, together with any posted policies referenced (Privacy Policy, Cancellation Policy, etc.) and any written invoice/quote/booking confirmation, constitute the entire agreement between you and us regarding the services, superseding prior discussions.

REFUND POLICY

Greater Sacramento Mobile Notary & Apostille

Overview

This Refund Policy explains when refunds may be issued for Mobile Notary, Apostille Services, and Loan Signing Agent services.

Refunds are handled based on the service category and costs already incurred (time reserved, travel, printing, shipping, and government fees).

Reservation Deposits

The $79 Reservation Deposit is credited toward your final total once services are completed.

Deposits are not refundable in the following situations:

  • No-shows

  • Late cancellations (see Cancellation Policy)

  • If the notary arrives and cannot complete service due to client/signer issues (ID, missing signer, refusal to sign, missing documents, access denied)

Mobile Notary & General Notary Services
  • If notarization services are completed, notary fees and travel fees are not refundable.

  • If we are unable to perform the notarization due to legal compliance reasons (unacceptable ID, signer not willing/aware, suspected coercion), travel/time fees may still apply and are not refundable.

Loan Signing Agent Services
  • Signing fees are generally non-refundable once the appointment occurs, because they cover time reserved, travel, printing (if included), and completion/return requirements.

  • If a re-sign is required due to our notarial mistake (rare), we will make commercially reasonable efforts to correct it. Refunds are not guaranteed and are evaluated case-by-case.

Apostille Services (Important)

Apostille work often involves third-party and government-related costs that are not reversible.

Non-Refundable Apostille Costs May Include:
  • Government filing/processing fees (where applicable)

  • Shipping/courier charges

  • Printing, scanning, document preparation time

Government Rejection / Delay

If a government office rejects a document or processing is delayed, refunds are not guaranteed because:

  • rejection may be caused by document form/type issues outside our control, and

  • agencies control acceptance and timelines.

We will assist with identifying common fixes when possible, but additional service fees may apply.

Shipping Fees

Shipping fees are generally non-refundable once a label is purchased or a package is sent. Carrier delays or losses are outside our control; any refunds depend on carrier claim outcomes.

Duplicate Appointments / Client Error

No refunds are issued for errors such as:

  • Booking the wrong service

  • Providing the wrong address

  • Requesting the wrong document type

  • Failing to provide the required ID or signer presence

Refund Method and Timing

If a refund is approved:

  • Refunds are issued to the original payment method when possible

  • processing time typically depends on the payment provider (bank/card issuer timelines)
